Abstract

Qiang, H., 2020. Research on compensation for pure economic losses in marine oil pollution cases. In: Bai, X. and Zhou, H. (eds.), Advances in Water Resources, Environmental Protection, and Sustainable Development. Journal of Coastal Research, Special Issue No. 115, pp. 50-52. Coconut Creek (Florida), ISSN 0749-0208.

With the rapid development of China's economy, the demand for oil is also increasing day by day. Oil is an indispensable economic resource for the development of modern countries. At the same time of the sharp increase in the volume of oil transportation at sea, the oil leakage in the process of transportation has also led to a series of marine oil pollution accidents. After the marine pollution and oil pollution accident occurred in our country, it is a controversial issue which individuals and departments should file lawsuits for claims for pure economic losses. The basis for the identification of pure economic loss in marine oil pollution damage lies in that the victim is a third party other than the direct party involved in the tort and the loss has nothing to do with the damage caused by the infringement of absolute right or tangible property. With the frequent occurrence of oil spill accidents and the improvement of people's awareness of rights protection, the research on compensation for pure economic loss in marine oil pollution damage has become more and more important and urgent. In view of this, this paper puts forward the countermeasures that should be taken for the compensation of pure economic loss in marine oil pollution in China.
